Texting a customer who contacted you first
- The do-not-call rule excepts 'any telephone solicitation that would be authorized or permitted by federal law or regulation relating to a telephone solicitation' (§ 44-1282(A)), which brings in the federal exemptions without restating them.
- Registration does not apply to soliciting previous customers under the same business name, subject to conditions (§ 44-1273(A)(8)).
- The statute does not address non-sales or job-status texts.

Penalties
A violation of § 44-1282 is an unlawful practice under the Consumer Fraud Act (§ 44-1522), and the Attorney General may seek a civil penalty that 'shall not exceed $1,000 per violation' (§ 44-1282(B)). The article sets no statutory damages for consumers.
What the statute does not settle
- Whether Arizona's other solicitation rules, written for 'voice communication', apply to texts: the statute's definition does not cover them.
