Texting a customer who contacted you first

  • The Act exempts 'a person soliciting business from prospective consumers who have an existing business relationship with or who have previously purchased from the business enterprise for which the solicitor is calling if the solicitor is operating under the same business enterprise' (§ 775C.5, exemption 20).
  • It also exempts a person who solicits contracts for the maintenance or repair of goods previously purchased from that person, and a sale completed at a later face-to-face meeting, with conditions (§ 775C.5, exemptions 12 and 3).
  • The Act has no express exemption for replying to someone who contacted the business first, and it does not address non-sales or transactional messages.

This matters for missed-call text-back, which replies to someone who just called the business. Federal rules and the reply-versus-marketing line are covered in is missed-call text-back legal?

Penalties

A called party may sue to stop the violation and recover actual damages or $500, whichever is greater, up to three times that for a willful or knowing violation (§ 775C.6). The Act has no STOP notice or cure period and no attorney-fee clause.

What the statute does not settle

  • The Act does not define 'commercial telephonic sales call' or 'commercial telephone solicitation', so it does not say in so many words that the hour and frequency limits reach texts.
  • This page was written from the enrolled bill (HB 3168, 2022). We could not load the codified text on the state's code site on the day we checked, so later amendments, if any, are not reflected.
